RAGE - RACKETEER ASSOCIATED GROUPS & ESTABLISHMENTS ACT 2018

Summary:  An act aimed towards providing extending criminal penalties to criminal acts committed as part of a criminal organization. The RAGE Act, for short, focuses as well on leadership of such criminal groups and allows indictment of those who order or are assisting in committing such acts.

To the honorable members of the court, I, TiMoN, the highest statutory authority of the state wish to submit the following proposal as a legislative measure to counter the ever rising organized criminal activity within the State of San Andreas. as out detailed below.

 


 

Section 1.: DEFINITIONS

  • "Racketeering" shall refer to to any of the following activities.
  1. Any violation of state statutes against murder, kidnapping, extortion, arson, robbery, bribery or fraud.
  2. Drug and arms production and trafficking. 
  3. Money laundering.
  4. Acts of terrorism,  possession or usage of biological weapons, .possession or usage of weapons of mass destruction.
  5. Murder-for-hire and contract killing.
  • "Pattern of Racketeering Activity" shall refer to two or more acts listed as Racketeering and have the same or similar purposes, results, participants, victims, or methods of commission.
  • No crime can be a part of a RAGE "Pattern of Racketeering Activity" unless it is included in this section.
  • "Criminal Organization" shall refer to an organized criminal group of five or more people that demonstrate a Pattern of Racketeering Activity.
  • "Criminal Group HQ" shall refer to the main gathering point of Criminal Organization members.
  • "Criminal Group Leader" shall refer to any individual within a Criminal Organization who is capable of commanding lower ranked members.
  • "Shutdown Period" shall refer to a period of time no less than 7 days and no more 30 days at which a Criminal Group HQ is inaccessible to the public.

Section 2.: CRIMINAL PENALTIES

  • Whoever violates any provision of Section 1 shall be imprisoned not more than 20 years (or for life if the violation is based on a racketeering activity for which the maximum penalty includes life imprisonment), and shall forfeit to the State any property which is deemed fitting of the "Criminal Group HQ" definition.
  • Upon conviction of a person under this section, the court shall enter a judgment of forfeiture of the property to the State and shall also authorize the State to seize all property ordered forfeited upon such terms and conditions as the court shall deem proper. 
  • Following the seizure of property ordered forfeited under this section, the State shall lock down the seized property for no less than 7 days, and no more than 30 days.
  • Any property right or interest not exercisable by, or transferable for value to, the State shall expire and shall not revert to the defendant until the end of the Shutdown Period.
  • Any materials, items or objects inside a seized Criminal Group HQ shall be confiscated by the State and disposed of as deemed fitting.

Section 3.: EXPEDITION OF ACTION

  • Evidence denotes any material such as books, paper, document, record, recording, or other material which showcase Racketeering activity.
  • Civil investigative demand denotes any person or enterprise may be in possession, custody, or control of any documentary materials relevant to a racketeering investigation, materials include those denoted in the Evidence subsection, as well as legal advertisement-influenced recruitment into Criminal Organizations.

This legislative action, if passed, shall come into effect and be enforceable 3 days after being signed.

 I, hereby approve of this legislative ordinance being forwarded for the State Senate to be approved and implemented on the date of 19th November, 2018.

A favorable step in the right direction in fighting organized crime in San Andreas. Cracking down on criminal organizations and their prominent members should be done as fast as possible as it will make our state safer and more civil.

Could you please elaborate a little more on how a racketeering activity is distinguished from an individual felony? I'm certain that no legal and honest business would like to have it's headquarters taken away because two of their members decided to join the dark side.

A racketeering activity is only considered as such if it's committed by a criminal organization, ergo five or more people. That alone is not grounds for prosecution under the RAGE Act, a repetitive behavior of such activities by those certain members must be documented before this act can be invoked.

I see, thanks for the elaboration. It's an effective measure against criminals and should have full support of honest civilians of the State.
