ARTICLE IX. BUSINESS REGULATIONS


SA-PSC § IX.1. State businesses

Any business that has declared themselves as a business and is operating on the soil of San Andreas is hereby considered to follow the Business Regulations and is to be considered as a business in the eyes of the State. Specialized businesses (furniture, dealership, trucking) must fill the need of demand for their services, activity requirements and must be an established group (/group). The State reserves the right to conduct investigations and audit the businesses at any time. Failure to abide by the Business Regulations will result in immediate dismissal from the program and/or monetary consequences or a jail sentence.

SA-PSC § IX.2. Accounting
All State funded businesses are obligated to keep track of their income and outcome and forward the Department of Treasury a monthly report. Failure to provide monthly accounting statistics will result in removal from the program and already given funds for the month to be retrieved.


SA-PSC § IX.3. Falsifying records [F]
Any attempt to forge documents or falsify accounting documents is classed as a felony charge.

SA-PSC § IX.4. Official State prices for vehicles
State dealership businesses must follow the list below when purchasing or selling a standard condition or class vehicle. The dealership is required to purchase vehicles from any citizen at all times and refund them the money they receive from selling the vehicle to the State's dealership (NPC). 


Dealerships do not need to follow the pricelist when it comes to exchanging heavily modified, unique and high-end vehicles which are the following:


Any vehicle that has the following modification is excluded from the state assigned dealership price


(( Clarifications: Players are still allowed to make deals with each other. State owned dealerships are used like you would use the old dealership function. If you wish to sell your vehicle for the dealership price, the State owned dealership MUST accept the vehicle and sell it back to the dealership for you and transfer you the money - price can be negotiated with in the range of 10,000$. Please note that you will only get the dealership price for the vehicle, if you have modifications or you have it in a upgraded version that will NOT be reimbursed back to you. State run dealerships can be negotiated with if you wish to sell a high-end, unique or modified vehicle - but they are NOT required to make the deal if the price does not fit them and you do not come to a deal. ))

SA-PSC § IX.5. Official State pricelist for furniture & construction companies
Furniture & Construction companies must follow the appointed pricelist found below when offering their services to clients. Price may vary by the amount of furnishing objects used and the cost of the purchased furnishing objects: 0-10 objects ($5,000), 11-20 objects ($10,000), 21-30 objects ($15,000), 31+ objects ($20,000). Each furniture & construction company may add their own price for drawing up sketches/blueprints for the client and ask additional fees for various of services if the client requests so.


SA-PSC § IX.6. Official State pricelist for logistical companies
Transportation companies may offer to deliver crates and gas to their customers ranging from 200$ to 400$ per crate and 10$ to 40$ per liter of fuel. Price could vary based on the location of the business.


SA-PSC § IX.7. Usage of State Business Support Funds
Funds can be used to cover employee paychecks to a reasonable extent, purchasing tools to promote company services and tools required to provide services.

 

SA-PSC § IX.8. Gambling licens[F] 

In order to operate as a casino and hold gambling related activities/games the owner/lessee of the said business must have obtained a gambling license from the Department of Licensing. The State Government holds the right to make random check-ups to confirm the validity of the dealers and if the business has a valid gambling license. Please note that all dealers must be verified by the casino owner/lessee and listed as official dealers of said enterprise in the state database or on their own website. Any property, including money, used in violation of the provisions of this section may be seized by the San Andreas Police Department and forfeited to the United States.
If there are organized illegal gambling activities inside a casino, the fines for the owner of the casino are as it follows:

  • $500,000 on first offence;
  • Seizing the property on second offence for up to 14 days;
  • Seizing the property permanently on third offence; (( will be auctioned ))

PURPOSE
The State law, hereafter referred to as "the law", are series of articles and sections defining illegal acts, in order to ensure safety and security of the citizens of the San Andreas State, and the state in which they reside.

 

Triple-asterisk (***) are the codes referring to national security, which is a matter where the Federal Bureau of Investigation must be involved and informed of, and is given the authority to lead cases where the crimes of that section are committed.

 

[F] stands for felony classification of the crime.

[M] stands for misdemeanor classification of the crime.

[IF] stands for infraction classification of the crime.

ARTICLE I. REPRESENTATIVES OF EXECUTIVE AND JUDICIAL BODIES


SECTION I. Representatives of the State Government

As per the Constitution of the United States, Governor is the executive government official for the State of San Andreas, with his chosen cabinet members who may execute various duties as designated by the Governor. The mayor of Fort Carson is the elected government official for the Fort Carson Municipality who has executive control over its territory and who is supervised by the Governor.

 

SECTION II. Powers and duties of the State Government

The Governor of San Andreas State is granted power to:

  • Create and implement new state laws;
  • Add amendments to current state laws;
  • Set property taxes per region;
  • Set toll fees per region;
  • Set base paycheck for state emergency services;
  • Close or open stations for state emergency services;
  • Add or remove vehicles from state emergency services;
  • Bear the executive control of the State and all its cities and territories;
  • Promote measures that enrich the quality of life of the citizens of the State;
  • Work along with the guidance of The Congress;
  • Use state government budget for various projects;
  • Propose operations to be conducted by state emergency services;
  • Initiate impeachment of a State Official; 

 

The Chief of the San Andreas Police Department is granted the power to:

  • Assume any able-bodied and of sound mind individual to assist in the enforcement of the state law, as well judiciary orders of the court;
  • Ensure the State Police has sufficient manpower to combat crime;
  • Ensure the State Police has equipment and weapons necessary to overpower criminal forces;
  • Take necessary actions to ensure law and order in the State;
  •  

 

The Sheriff of the San Andreas Sheriff Department is granted the power to:

  • Assume any able-bodied and of sound mind individual to assist in the enforcement of the state law, as well judiciary orders of the court;
  • Ensure the Sheriff Department has sufficient manpower to combat crime;
  • Ensure the Sheriff Department has equipment and weapons necessary to overpower criminal forces;
  • Take necessary actions to ensure law and order in the State;

 

Said individuals shall be labelled as Peace Officers and be held accountable to protect the safety of the citizens of the state and execute the orders of the judiciary branch.

 

SECTION III. Powers of a peace officer

Peace Officers are the only figures allowed by the security codes of the state to pursue violators, in a respectful and efficient manner, and as such have been granted the following powers and responsibilities:

 

  • To hold right of passage on the road when responding to an emergency.
  • To be able to violate the speed limits and traffic orientation if needed to perform their duties.
  • To restrict access to an area if there is an emergency in progress, or a possible and concrete risk of one happening, such as death threats to the dwellers of said area or an important figure such as a politician visiting it.
  • To detain an individual upon probable cause if the act was witnessed by a law enforcement officer or another individual.
  • To seize the properties of others if pertaining to a violation of one of the security codes or an order of the court, and to provide the reason of why the seizure happened when asked by the victims or when interrogated in front of the judiciary branch.
  • To bear arms and other military equipment forbidden to the general population, with lawful intent and justification.
  • To show their departmental badge number or identification document when the subject of a complaint unless not feasible due to dangerous elements around the officer
  • To approve search and arrest warrants, if ranked Deputy Chief or Chief of the Police Department.
 

SECTION IV. Parties to criminal actions

For prosecution of criminal acts, in case the prosecuting agency is on the state level, the prosecution shall be done in the name of the state.

 

Currently, the agencies authorized to prosecute for the state of San Andreas and Fort Carson Municipality is the San Andreas Police Department's appointed prosecutor and the Attorney General who is appointed by the governor.


SECTION V. Parties to a court hearing

During a court hearing, the party requesting the judiciary branch to punish the offender shall be defined as prosecutors, and the party being prosecuted shall be defined as the defendant.

 

The defendants are entitled to a speedy and public trial overseen by an unbiased magistrate and are also entitled the right to produce witnesses on their behalf that shall be confronted with the opposition.

 

No one shall be prosecuted for the same crime twice as well held guilty of a charge before having been judged by the court.

ARTICLE III. CRIMES AGAINST THE UNITED STATES OR A STATE


SA-PSC § II.1. Corruption and misuse of public office*** [F]

The act of misusing the powers of public office for personal or someone's gain.

This charge has an accessory punishment coupled with arrest, see SA-PSC § 72.

 

SA-PSC § II.2. False imprisonment [M]
The act of restricting a person's freedom without proper justification.

 

SA-PSC § II.3. Impersonation of a law enforcement, emergency service, judicial or government official. [F]

Pretending to be or acting as a peace officer or a federal judge while not being a member of such an organization.

  • SA-PSC § II.3.1. Law Enforcement vehicles
    • San Andreas Police Department is the only recognized law enforcement agency on the state level and has jurisdiction in each of the three cities, along with the counties. The SAPD's field staff vehicles are to be colored in combination of black and white colors for cities and combination of beige and white colors for counties, while the supervisory and command staff vehicles are to be colored according to command staff and higher ranks preference with the permission of Secretary of Law Enforcement, with the exception of unmarked vehicles, but inclusive of high speed pursuit vehicles and divisional vehicles. The vehicles used by the Academy Division are to be colored fully white for training purposes. The writings of the markings on these vehicles is to be white or blue. The primary color of emergency lights is to be blue and red. These vehicles may make use of emergency audible sirens.
    • The Federal Bureau of Investigation is the only recognized federal law enforcement agency and has jurisdiction throughout the United States of America. The FBI's vehicles are mostly unmarked and colored in variety of colors. Generally, the primary colors are black and dark-green depending on the division. The writings of the markings on these vehicles is to be yellow or white. The primary color of emergency lights is to be blue and red. These vehicles may make use of emergency audible sirens.

 

  • SA-PSC § II.3.2. Emergency Medical or Fire Service vehicles
    • San Andreas Fire Department which incorporates the Emergency Medical Services is the only recognized emergency service agency on the state level and has jurisdiction in each of the three cities along with the counties. The SAFD's official vehicles are to be colored in combination of red and white colors. The primary color of emergency lights is to be red, whilst combinations may include white or yellow as secondary. These vehicles may make use of emergency audible sirens.

 

  • SA-PSC § II.3.3. Non-emergency vehicles
    • Non-emergency vehicles include vehicles of the San Andreas Towing and Impound services, street maintenance vehicles (Sweepers, Trashmasters, ...) which may make use of orange and red flashing lights to alert pedestrians and drivers of hazards they may present on the road. These vehicles may not make use of any audible emergency sirens.

 

  • SA-PSC § II.3.4. Miscellaneous
    • Usage of neon lights in red and blue combination is prohibited as it may appear as law enforcement emergency lights.
    • Writings on vehicles which resemble a law enforcement agency, emergency service or government is prohibited.
    • Any actions or modifications to vehicles which would make them resemble law enforcement, emergency service or government is strictly prohibited.
      ⚬ The San Andreas Highway Patrol fleet are to be colored black and white regardless of division. Exceptions for Unmarked units. All departmental fleet may make use of emergency audible sirens and lights with the colors red, blue and amber. (Clarifying unmarked unit vehicles are those that do not have any markings that may identify a vehicle as a law enforcement vehicle such as wordings and plate numbers. Ex: SA #### HP)

 

SA-PSC § II.4. Improper entry by alien***

Any person who unlawfully locate himself inside the state without being authorized or attempts to deceive the authorities to do so, ranging but not necessarily limited to .: crossing the border away from an inspection point or by deception, concealing facts by providing false information and or documents or otherwise overstaying when not allowed.

 

SA-PSC § II.5. Human trafficking*** [F]
Any sort of action, regardless of reasoning, whose aim is to aid or force another person to get across the state territory for an unlawful purpose, ranging but not necessarily limited to .: expatriating an individual so that he may be harmed or taken captive, forcing someone in to prostitution or slavery, aiding an unlawful alien to gain entrance.

 

SA-PSC § II.6. Tax Evasion*** [F]

The act of avoiding to pay taxes to the state.

 

SA-PSC § II.7. Contempt of court*** [M]

Any type of action or conduct that disrespect or show someone's disobedience toward a court of law during a hearing.

 

SA-PSC § II.8. Perjury*** [F]

Any individual, who after having been summoned by a magistrate, provide misleading pieces of information that deviate from what has really happened, is going to be punished for his false testimony.

 

SA-PSC § II.9. Failure to abide a court order*** [M]

Any individual who fails to respect an order issued to him by a magistrate.

 

SA-PSC § II.10. Obstruction of justice [M]

The act of interfering in an investigation or legal action by influencing or forcing in any ways the parties involved not necessarily limited to government officials and/or potential witnesses not to present themselves in court or otherwise make them testify false allegations.
The act of providing false information or otherwise impeding the course by any other mean is covered by this article as well.

 

SA-PSC § II.11. Tampering with evidence [F]
The act of interfering in a governmental, law enforcement or regulatory authority investigation and/or legal proceeding, by altering the state of evidence.

 

SA-PSC § II.12. Failure to pay a fine [M]

The act of failing to pay a fine that has been lawfully forced upon him due to a violation of the codes of the state from the moment it was issued. Can be punished either by arrest and impounding of the vehicle or by forcing the individual to go to the nearest ATM and pay the fine, up to officer discretion.

 

SA-PSC § II.13. Resisting arrest [M]

Any action that an individual performs to oppose resistance to a law enforcement official that is lawfully detaining him.

 

SA-PSC § II.14. Unidentifiable persons [M]

Any sort of action that prevents a person to be properly identified by peace officers, including all forms of alterations to their bodies that can range but are not necessarily limited to what is mentioned in this act, such as wearing a mask or burning one's fingerprints or a person who does not identify himself due to sheer will, or because of being impossibilities can be detained until his identity is discovered. The exception to this are tactical and investigative law enforcement bodies during execution of operations. However, uniformed officers may not wear masks.

SA-PSC § II.15. Vigilantism [M]

Any individual or organization acting in a law enforcement capacity without the necessary legal authority to do so.


SA-PSC § II.16. Disturbing the peace [M]
A person who creates a dangerous or intimidating situation in a public place or in the public area of private property.

SA-PSC § II.17. Misuse of emergency hotlines [M]
The act of requesting an emergency response by misuse of the hotline system, when no actual emergency exists.

SA-PSC § II.18. False reporting [M]
The act of reporting to any peace officer, judge, or any other individual who is allowed to process crime complaints, the consummation of a crime that the reporter knows to have never happened.


SA-PSC § II.19. Riot [F]
The act of inciting a large group of persons peacefully located in a public or private area, to perform civil unrest and/or any other type of violent actions.

SA-PSC § II.20. Trespassing in a restricted area [F]
A person who, without proper authorization, enters any government-managed facility, or restricted section of a public government building that is secured with the intent of keeping non-authorized personnel out due to a security or safety hazard.

SA-PSC § II.21. Environmental damage [M]

The act of harming the environment of the state in any ways, ranging but not necessarily limited to .: improperly disposal of waste, hunting or otherwise handling endangered wildlife and so on. The following wildlife is to be considered endangered wildlife:

Bluefin Tuna 
Atlantic Salmon 
Pacific Lamprey 
Steelhead Trout 
Sea Turtle 
Marlin

 

Possession of the endangered wildlife and/or hunting will result in an arrest by the law enforcement agencies and seizing of the cargo.


SA-PSC § II.22. Blocking public access roads/paths [M]
Any public access road or a pedestrian path must be kept clear for atleast two citizens to move freely side-by-side. Obstructing any public access road, parking lot or a pedestrian path by adding furniture is considered to be a misdemeanor act. The owner of the said property is responsible and will face a written notice, after two days of said written notice and if the owner has not still removed the obstacle, the owner will be given a citation (maximum penalty of 25,000$) by the State Government. Failure to pay said citation to the Department of Treasury within a period of another two days and/or has failed to remove the obstruction from the road/path will result in an arrest and the blockage on the road/path to be cleared by the State.
 

SA-PSC § II.23. Illegal gambling [M]

Commercial gambling means gambling where the owner, operator, or host of a gambling event receives something of value from the game or charges a fee to the players participating. Whoever conducts, finances, manages, supervises, directs, or owns all or part of an illegal gambling business shall be fined under this title or imprisoned not for more than 6 months, or both.
Gambling inside a casino without an active gambling license is considered illegal gambling. The term “gambling” includes but is not limited to bookmaking, maintaining slot machines, roulette wheels or dice tables, and conducting lotteries or numbers games, or selling chances therein.

 

SA-PSC § II.24. Electoral bribery *** [F]

A person cannot ask for, receive or obtain, or give or confer, any property or benefit with the intention of influencing the vote of a person at a state election. If a person is found guilty of this offence, a court may impose a penalty of monetary fine or imprisonment.

 

SA-PSC § II.25. Illegal street racing [M]

A person who, without having a proper license/authority to host a street racing activity, or participates in said activity is submitted to an arrest and vehicle impounded. All events that take place on public grounds must be registered through law enforcement and all such permits can be granted by S.A.P.D. Lieutenant+ after presenting certain documents including a safety plan.

 

SA-PSC § II.26. ALS Certification [M]
To ensure the safety of the citizens of the state, and to provide proper medical assistance.
An ALS program was invented by the San Andreas Fire Department, ALS fields are as defined:

  • Intravenous
  • Intraosseous
  • Pharmacology
  • Pneumology
  • Cardiology
  • Blood Draw

ALS stands for Advanced Life Support. A person who provide ALS without certification issued officially by the San Andreas Fire Department, shall be fined with no less and no more than $50,000 on first offence, imprisoned for 1 year on second offence, imprisoned for 5 years on third offence

ARTICLE VIII. MISCELLANEOUS LAWS


SA-PSC § VII.1. Attempt to do a crime

Any attempt or conspiracy to commit a crime is punishable by the same punishment issued should the offence have been committed in the first place.

 

SA-PSC § VII.2. Soliciting

Any individual who encourages another to perform a crime shall be punished by the same penalty for the crime being solicited for.

 

SA-PSC § VII.3. Accessory after the fact

Any individual who willingly help a wanted fugitive, by means of helping him elude the authorities or destroy any form of evidence after the fugitive has committed a crime, is punishable in the same way the fugitive he's unlawfully helping would be punished if arrested.

 

SA-PSC § VII.4. Criminal Accomplices

Any individual who willingly help another person to commit a crime, by any forms of assistance, is punishable by the same penalty that would be issued to the individual he is helping.

 

SA-PSC § VII.5. Expulsion of corrupted government officials

Any individual part of any governmental organization, be it local, state or federal, who has been found to have committed an act of corruption or the misuse of his powers for foul reason, is to be expelled from said office and be barred from enlisting in others for a minimum period of time of two weeks.

 

SA-PSC § VII.6. Forced commitment to a psychiatric facility

Any individual that poses a risk to themselves and others due to fallacies of the mind, can be detained by law enforcement officers and restricted into a secure facility pending a psychiatric evaluation.

 

SA-PSC § VII.7. Ignorance of the law

Any individual who claims ignorance of the law to avoid the consequences of their actions, shall not have said claims deemed as a reasonable excuse.

 

SA-PSC § VII.8. Providing aid to a Peace Officer

Only off-duty law enforcement officials are permitted to provide aid to on-duty Peace Officers who are in distress. Prior to providing aid, request permission from the Peace Officer to do so. If the Peace Officer approves your request to provide aid, you may then do whatever is necessary in the specific situation to help the Peace Officer execute his duties.

 

SA-PSC § VII.9. Restricted Areas

Certain government facilities and buildings are to have restricted access to the public due to the nature of the agency residing in the area and the safety of the public and the employees themselves. As such, the following areas are to be considered of restricted access:

  • Los Santos Police Department including the interior space the yard on the northern side, the garage, and the premises in front of the building on the west side.
  • Las Venturas Police Department including the interior space, the parking on the west side, the garage and the premises on the south side of the building.
  • San Fierro Police Department including the interior space, the parking on the south side, the garage and the premises of the building on each side.
  • Special Weapons and Tactics training facility at north-east Las Venturas including the premises around the exterior fence.
  • Special Weapons and Tactics headquarters at Los Santos, Commerce, including the premises west of garage to the sewer access road and the garage.
  • Federal Bureau of Investigation, Los Santos Headquarters, including the interior space, the garage and the premises of the building on all sides.
  • Federal Bureau of Investigation, Las Venturas Office, including the interior space, the garage and the premises of the building on all sides.
  • Federal Bureau of Investigation, San Fierro Office, including the interior space, the parking space on the west side and the premises of the building on all sides.
  • Area 51 including the premises stretching to the access road on the west side, to the hills on the north and east side and south side.
  • White House including the premises stretching throughout the whole Verdant Bluffs area.

Do note that the citizens may access the public areas of the aforementioned buildings such as their reception areas and lobbies. However, the access to these areas as well can be restricted in times of need, the employees of the agency in question reserve the right to temporarily restrict additional area related to their building due to security threats or other reasons which require restricted access.

SA-PSC § IX.4. Official State pricelist for furniture & construction companies
Furniture & Construction companies must follow the appointed pricelist found below when offering their services to clients. Price may vary by the amount of furnishing objects used and the cost of the purchased furnishing objects: 0-10 objects ($5,000), 11-20 objects ($10,000), 21-30 objects ($15,000), 31+ objects ($20,000). Each furniture & construction company may add their own price for drawing up sketches/blueprints for the client and ask additional fees for various of services if the client requests so.


SA-PSC § IX.5. Official State pricelist for logistical companies
Transportation companies must adhere to the price range given below for delivery charges to their customers.

Any form of promotional or discount offer must comply with the range of prices set for delivery charges under state law. Any form of promotional or discount offer is not permitted to go below the minimum threshold for delivery charges specific under state law.

Failure to obey the prices range shall be punished with a monetary fine no less than $100,000 and no more than $500,000.

- For crates delivery: 

   Minimum $200 per crate;

   Maximum $400 per crate;

- For liquid delivery:

   Minimum $10 per liter;

   Maximum $40 per liter. 
 

SA-PSC § IX.6. Gambling licens[F] 

In order to operate as a casino and hold gambling related activities/games the owner/lessee of the said business must have obtained a gambling license from the Department of Licensing. The State Government holds the right to make random check-ups to confirm the validity of the dealers and if the business has a valid gambling license. Please note that all dealers must be verified by the casino owner/lessee and listed as official dealers of said enterprise in the state database or on their own website. Any property, including money, used in violation of the provisions of this section may be seized by the San Andreas Police Department and forfeited to the United States.
If there are organized illegal gambling activities inside a casino, the fines for the owner of the casino are as it follows:

  • $500,000 on first offence;
  • Seizing the property on second offence for up to 14 days;
  • Seizing the property permanently on third offence; (( will be auctioned ))

ARTICLE VI. CONTROL OF DANGEROUS SUBSTANCES AND ITEMS


 

SA-PSC § V.1. Possession of an illegal substance [M]/[F]

It is strictly forbidden in the great state of San Andreas, the acts of introducing, manufacturing, possessing or distributing harmful drugs like heroin or cocaine or meth, with the exception of weed which may be legally possessed by an individual for up to a limit of 750 grams. If ingredients are found alongside with the illegal substance, and they are used to produce these substances, they are to be seized with the drugs. The exception to prohibited possessions also include the sole possession of upto two joints.

 

  • SA-PSC § V.1.1. Property Search
    If the subject of a search is found to be in possession of more than 250 grams of heroin/meth or 750 grams of weed a warrant request may be sent to the persons of authority to approve warrants, against the subject's properties, which are then to be searched and seized of eventual illegal items that are found. 
  • SA-PSC § V.1.2. Property Seize 
    If upon execution of a search warrant, a property is found to be used for the storage of illegal substances (such as Weed, Meth, Heroin or Cocaine) in quantities more than the possession limit, i.e., more than 250 grams for heroin/meth or more than 750 grams for weed, the property may be seized for a period of 7 days to conduct further investigation into the owner of the property and the use of the produced substance.
  • SA-PSC § V.1.3. Manufacturing of an illegal substance
    The manufacture of weed is here by declared legal if produced in a controlled property (Weed/Garden Houses). The quantity produced should be less than or equal to the possession limit i.e., 750 grams. If a group or an individual is found manufacturing/producing weed in any quantity outside controlled properties (such as weed farms) it will be considered as a felony and be treated as such. 
    Note: This does not apply to other illegal substances such as Heroin, Cocaine & Meth, they are and will be illegal if found while manufacturing or in possession.

 

SA-PSC § V.2. Possession of an assault weapon or a sniper rifle [F]

The possession of military grade weapons is strictly prohibited in the state of San Andreas. If a person is found possessing any of the following firearms, they will be immediately seized along with person's weapon license:

  • Assault Rifles (M4 and AK 47)
  • Sniper Rifles

 

  • SA-PSC § V.2.1. Property Seize  
    Any property in the state if found containing illegal military grade weaponry may be seized by law enforcement agencies for a period of 14 days for further investigation along with the illegal weapons.

     

SA-PSC § V.3. Illegal brandishing of a weapon [M]
It is strictly forbidden to display any kind of weapon in open sight on public grounds or any business setting without a lawful purpose. 

 

SA-PSC § V.4. Arms trafficking [F]

It is strictly forbidden in the great state of San Andreas, the act of introducing, manufacturing or distributing any type of weapon in the state without receiving prior authorization by the competent institutions of the state. Subjects whose right to bear arms has been restricted by a judiciary branch of the state are not allowed to possess weapons until said order expires.

The mere handling of explosive material, or other biological and/or chemical agents that can greatly affect the well-being of others, is strictly illegal.

A police officer may revoke your weapon license after you have been found committing a crime involving weapons

ARTICLE III. CRIMES AGAINST THE UNITED STATES OR A STATE


 

SA-PSC § II.1. Corruption and misuse of public office*** [F]

The act of misusing the powers of public office for personal or someone's gain.

This charge has an accessory punishment coupled with arrest, see SA-PSC § 72.

 

SA-PSC § II.2. False imprisonment [M]
The act of restricting a person's freedom without proper justification.

 

SA-PSC § II.3. Impersonation of a law enforcement, emergency service, judicial or government official. [F]

Pretending to be or acting as a peace officer or a federal judge while not being a member of such an organization.

  • SA-PSC § II.3.1. Law Enforcement vehicles
    • San Andreas Police Department and San Andreas Sheriff Department are the only recognized law enforcement agencies on the state level and have jurisdiction in each of the three cities, along with the counties. The SAPD's field staff vehicles are to be colored in combination of black and white colors, while the SASD must use a combination of green and white colors. The supervisory and command staff vehicles are to be colored according to command staff and higher ranks preference with the permission of Secretary of Law Enforcement (Unless the position is VACANT, in which case, the permission will come directly from the Governor), with the exception of unmarked vehicles, but inclusive of high speed pursuit vehicles and divisional vehicles. The vehicles used by SAPD's Academy Division are to be colored fully white for training purposes. The writings of the markings on these vehicles is to be white or blue. The primary color of emergency lights used by both departments is to be blue and red. These vehicles may make use of emergency audible sirens.
    • The Federal Bureau of Investigation is the only recognized federal law enforcement agency and has jurisdiction throughout the United States of America. The FBI's vehicles are mostly unmarked and colored in variety of colors. Generally, the primary colors are black and dark-green depending on the division. The writings of the markings on these vehicles is to be yellow or white. The primary color of emergency lights is to be blue and red. These vehicles may make use of emergency audible sirens.

 

  • SA-PSC § II.3.2. Emergency Medical or Fire Service vehicles
    • San Andreas Fire Department which incorporates the Emergency Medical Services is the only recognized emergency service agency on the state level and has jurisdiction in each of the three cities along with the counties. The SAFD's official vehicles are to be colored in combination of red and white colors. The primary color of emergency lights is to be red, whilst combinations may include white or yellow as secondary. These vehicles may make use of emergency audible sirens.

 

  • SA-PSC § II.3.3. Non-emergency vehicles
    • Non-emergency vehicles include vehicles of the San Andreas Towing and Impound services, street maintenance vehicles (Sweepers, Trashmasters, ...) which may make use of orange and red flashing lights to alert pedestrians and drivers of hazards they may present on the road. These vehicles may not make use of any audible emergency sirens.

 

  • SA-PSC § II.3.4. Miscellaneous
    • Usage of neon lights in red and blue combination is prohibited as it may appear as law enforcement emergency lights.
    • Writings on vehicles which resemble a law enforcement agency, emergency service or government is prohibited.
    • Any actions or modifications to vehicles which would make them resemble law enforcement, emergency service or government is strictly prohibited.

 

SA-PSC § II.4. Improper entry by alien***

Any person who unlawfully locate himself inside the state without being authorized or attempts to deceive the authorities to do so, ranging but not necessarily limited to .: crossing the border away from an inspection point or by deception, concealing facts by providing false information and or documents or otherwise overstaying when not allowed.

 

SA-PSC § II.5. Human trafficking*** [F]
Any sort of action, regardless of reasoning, whose aim is to aid or force another person to get across the state territory for an unlawful purpose, ranging but not necessarily limited to .: expatriating an individual so that he may be harmed or taken captive, forcing someone in to prostitution or slavery, aiding an unlawful alien to gain entrance.

 

SA-PSC § II.6. Tax Evasion*** [F]

The act of avoiding to pay taxes to the state.

 

SA-PSC § II.7. Contempt of court*** [M]

Any type of action or conduct that disrespect or show someone's disobedience toward a court of law during a hearing.

 

SA-PSC § II.8. Perjury*** [F]

Any individual, who after having been summoned by a magistrate, provide misleading pieces of information that deviate from what has really happened, is going to be punished for his false testimony.

 

SA-PSC § II.9. Failure to abide a court order*** [M]

Any individual who fails to respect an order issued to him by a magistrate.

 

SA-PSC § II.10. Obstruction of justice [M]

The act of interfering in an investigation or legal action by influencing or forcing in any ways the parties involved not necessarily limited to government officials and/or potential witnesses not to present themselves in court or otherwise make them testify false allegations.
The act of providing false information or otherwise impeding the course by any other mean is covered by this article as well.

 

SA-PSC § II.11. Tampering with evidence [F]
The act of interfering in a governmental, law enforcement or regulatory authority investigation and/or legal proceeding, by altering the state of evidence.

 

SA-PSC § II.12. Failure to pay a fine [M]

The act of failing to pay a fine that has been lawfully forced upon him due to a violation of the codes of the state from the moment it was issued. Can be punished either by arrest and impounding of the vehicle or by forcing the individual to go to the nearest ATM and pay the fine, up to officer discretion.

 

SA-PSC § II.13. Resisting arrest [M]

Any action that an individual performs to oppose resistance to a law enforcement official that is lawfully detaining him.

 

SA-PSC § II.13. Failure to Obey a Law Enforcement Officer [M]

It is unlawful for any person to fail or refuse to comply with any lawful order or direction of any Law Enforcement Officer.

 

SA-PSC § II.14. Unidentifiable persons [M]

Any sort of action that prevents a person to be properly identified by peace officers, including all forms of alterations to their bodies that can range but are not necessarily limited to what is mentioned in this act, such as wearing a mask or burning one's fingerprints or a person who does not identify himself due to sheer will, or because of being impossibilities can be detained until his identity is discovered. The exception to this are tactical and investigative law enforcement bodies during execution of operations. However, uniformed officers may not wear masks.

SA-PSC § II.15. Vigilantism [M]

Any individual or organization acting in a law enforcement capacity without the necessary legal authority to do so.


SA-PSC § II.16. Disturbing the peace [M]
A person who creates a dangerous or intimidating situation in a public place or in the public area of private property.

SA-PSC § II.17. Misuse of emergency hotlines [M]
The act of requesting an emergency response by misuse of the hotline system, when no actual emergency exists.

SA-PSC § II.18. False reporting [M]
The act of reporting to any peace officer, judge, or any other individual who is allowed to process crime complaints, the consummation of a crime that the reporter knows to have never happened.


SA-PSC § II.19. Riot [F]
The act of inciting a large group of persons peacefully located in a public or private area, to perform civil unrest and/or any other type of violent actions.

SA-PSC § II.20. Trespassing in a restricted area [F]
A person who, without proper authorization, enters any government-managed facility, or restricted section of a public government building that is secured with the intent of keeping non-authorized personnel out due to a security or safety hazard.

SA-PSC § II.21. Environmental damage [M]

The act of harming the environment of the state in any ways, ranging but not necessarily limited to .: improperly disposal of waste, hunting or otherwise handling endangered wildlife and so on. The following wildlife is to be considered endangered wildlife:

Bluefin Tuna 
Atlantic Salmon 
Pacific Lamprey 
Steelhead Trout 
Sea Turtle 
Marlin

 

Possession of the endangered wildlife and/or hunting will result in an arrest by the law enforcement agencies and seizing of the cargo.


SA-PSC § II.22. Blocking public access roads/paths [M]
Any public access road or a pedestrian path must be kept clear for atleast two citizens to move freely side-by-side. Obstructing any public access road, parking lot or a pedestrian path by adding furniture is considered to be a misdemeanor act. The owner of the said property is responsible and will face a written notice, after two days of said written notice and if the owner has not still removed the obstacle, the owner will be given a citation (maximum penalty of 25,000$) by the State Government. Failure to pay said citation to the Department of Treasury within a period of another two days and/or has failed to remove the obstruction from the road/path will result in an arrest and the blockage on the road/path to be cleared by the State.
 

SA-PSC § II.23. Illegal gambling [M]

Commercial gambling means gambling where the owner, operator, or host of a gambling event receives something of value from the game or charges a fee to the players participating. Whoever conducts, finances, manages, supervises, directs, or owns all or part of an illegal gambling business shall be fined under this title or imprisoned not for more than 6 months, or both.
Gambling inside a casino without an active gambling license is considered illegal gambling. The term “gambling” includes but is not limited to bookmaking, maintaining slot machines, roulette wheels or dice tables, and conducting lotteries or numbers games, or selling chances therein.

 

SA-PSC § II.24. Electoral bribery *** [F]

A person cannot ask for, receive or obtain, or give or confer, any property or benefit with the intention of influencing the vote of a person at a state election. If a person is found guilty of this offence, a court may impose a penalty of monetary fine or imprisonment.

 

SA-PSC § II.25. Illegal street racing [M]

A person who, without having a proper license/authority to host a street racing activity, or participates in said activity is submitted to an arrest and vehicle impounded. All events that take place on public grounds must be registered through law enforcement and all such permits can be granted by S.A.P.D. Lieutenant+ after presenting certain documents including a safety plan.

 

SA-PSC § II.26. ALS Certification [M]
To ensure the safety of the citizens of the state, and to provide proper medical assistance.
An ALS program was invented by the San Andreas Fire Department, ALS fields are as defined:

  • Intravenous
  • Intraosseous
  • Pharmacology
  • Pneumology
  • Cardiology
  • Blood Draw

ALS stands for Advanced Life Support. A person who provide ALS without certification issued officially by the San Andreas Fire Department, shall be fined with no less and no more than $50,000 on first offence, imprisoned for 1 year on second offence, imprisoned for 5 years on third offence.

SA-PSC § VII.9. Restricted Areas

Certain government facilities and buildings are to have restricted access to the public due to the nature of the agency residing in the area and the safety of the public and the employees themselves. As such, the following areas are to be considered of restricted access:

  • Los Santos Police Department including the interior space the yard on the northern side, the garage, and the premises in front of the building on the west side.

PURPOSE
The State law, hereafter referred to as "the law", are series of articles and sections defining illegal acts, in order to ensure safety and security of the citizens of the San Andreas State, and the state in which they reside.

 

Triple-asterisk (***) are the codes referring to national security, which is a matter where the Federal Bureau of Investigation must be involved and informed of, and is given the authority to lead cases where the crimes of that section are committed.

 

[F] stands for felony classification of the crime.

[M] stands for misdemeanor classification of the crime.

[IF] stands for infraction classification of the crime.

ARTICLE I. REPRESENTATIVES OF EXECUTIVE AND JUDICIAL BODIES


SECTION I. Representatives of the State Government

As per the Constitution of the United States, Governor is the executive government official for the State of San Andreas, with his chosen cabinet members who may execute various duties as designated by the Governor. The mayor of Fort Carson is the elected government official for the Fort Carson Municipality who has executive control over its territory and who is supervised by the Governor.

 

SECTION II. Powers and duties of the State Government

The Governor of San Andreas State is granted power to:

  • Create and implement new state laws;
  • Add amendments to current state laws;
  • Set property taxes per region;
  • Set toll fees per region;
  • Set base paycheck for state emergency services;
  • Close or open stations for state emergency services;
  • Add or remove vehicles from state emergency services;
  • Bear the executive control of the State and all its cities and territories;
  • Promote measures that enrich the quality of life of the citizens of the State;
  • Work along with the guidance of The Congress;
  • Use state government budget for various projects;
  • Propose operations to be conducted by state emergency services;
  • Initiate impeachment of a State Official; 

 

The Chief of the San Andreas Police Department is granted the power to:

  • Assume any able-bodied and of sound mind individual to assist in the enforcement of the state law, as well judiciary orders of the court;
  • Ensure the State Police has sufficient manpower to combat crime;
  • Ensure the State Police has equipment and weapons necessary to overpower criminal forces;
  • Take necessary actions to ensure law and order in the State;

 

 

The Sheriff of the San Andreas Sheriff Department is granted the power to:

  • Assume any able-bodied and of sound mind individual to assist in the enforcement of the state law, as well judiciary orders of the court;
  • Ensure the Sheriff Department has sufficient manpower to combat crime;
  • Ensure the Sheriff Department has equipment and weapons necessary to overpower criminal forces;
  • Take necessary actions to ensure law and order in the State;

 

Said individuals shall be labelled as Peace Officers and be held accountable to protect the safety of the citizens of the state and execute the orders of the judiciary branch.

 

SECTION III. Powers of a peace officer

Peace Officers are the only figures allowed by the security codes of the state to pursue violators, in a respectful and efficient manner, and as such have been granted the following powers and responsibilities:

 

  • To hold right of passage on the road when responding to an emergency.
  • To be able to violate the speed limits and traffic orientation if needed to perform their duties.
  • To restrict access to an area if there is an emergency in progress, or a possible and concrete risk of one happening, such as death threats to the dwellers of said area or an important figure such as a politician visiting it.
  • To detain an individual upon probable cause if the act was witnessed by a law enforcement officer or another individual.
  • To seize the properties of others if pertaining to a violation of one of the security codes or an order of the court, and to provide the reason of why the seizure happened when asked by the victims or when interrogated in front of the judiciary branch.
  • To bear arms and other military equipment forbidden to the general population, with lawful intent and justification.
  • To show their departmental badge number or identification document when the subject of a complaint unless not feasible due to dangerous elements around the officer
  • To approve search and arrest warrants, if ranked:
     - Deputy Chief or Chief of the Police Department;
     - Undersheriff or Sheriff of the Sheriff Department.
 

SECTION IV. Parties to criminal actions

For prosecution of criminal acts, in case the prosecuting agency is on the state level, the prosecution shall be done in the name of the state.

 

Currently, the agencies authorized to prosecute for the state of San Andreas and Fort Carson Municipality is the San Andreas Police Department's appointed prosecutor, the San Andreas Sheriff Department's appointed prosecutor and the Attorney General who is appointed by the governor.


SECTION V. Parties to a court hearing

During a court hearing, the party requesting the judiciary branch to punish the offender shall be defined as prosecutors, and the party being prosecuted shall be defined as the defendant.

 

The defendants are entitled to a speedy and public trial overseen by an unbiased magistrate and are also entitled the right to produce witnesses on their behalf that shall be confronted with the opposition.

 

No one shall be prosecuted for the same crime twice as well held guilty of a charge before having been judged by the court.

ARTICLE VI. CONTROL OF DANGEROUS SUBSTANCES AND ITEMS


 

SA-PSC § V.1. Possession of an illegal substance [M]/[F]

It is strictly forbidden in the great state of San Andreas, the acts of introducing, manufacturing, possessing or distributing psychoactive substances such as heroin, cocaine, meth, or weed.

 

  • SA-PSC § V.1.1. Property Search
    If the subject of a search is found to be in possession of a psychoactive substance listed at SA-PSC § V.1., a search warrant can be approved by the authority listed at SECTION III. Powers of a peace officer, against the subject's properties, which are then to be searched and seized of eventual illegal items that are found. 
  • SA-PSC § V.1.2. Property Seize
    If upon execution of a search warrant, a property is found to be used for the storage and/or production of illegal substances in any quantities, the property can be seized for a period of 7 days.

 

SA-PSC § V.2. Possession of an assault weapon or a sniper rifle*** [F]

The possession of military grade weapons is strictly prohibited in the state of San Andreas. If a person is found possessing any of the following firearms and/or explosive materials, they will be immediately seized along with the person's weapon license:

  • Assault Rifles (M4 and AK-47);
  • Sniper Rifles;
  • Explosive Ordinances (Rocket Propelled Grenade launcher, Improvised Explosive Device, Grenade, Molotov cocktail).

 

  • SA-PSC § V.2.1. Property Search

    If any of the firearms and/or explosive ordinances listed in SA-PSC § V.2. were found in possession, a warrant may be issued to the properties owned by the individual who was found in possession of the said firearms and/or explosive ordinances.

  • SA-PSC § V.2.1. Property Seize  
    Any property in the state is found containing illegal military-grade as defined in SA-PSC § V.2. may be seized by law enforcement agencies for a period of 14 days for further investigation along with the illegal weapons.

 

SA-PSC § V.3. Illegal brandishing of a weapon [M]
It is strictly forbidden to display any kind of weapon in open sight on public grounds or any business setting without a lawful purpose. 

 

SA-PSC § V.4. Arms trafficking [F]

It is strictly forbidden in the great state of San Andreas, the act of introducing, manufacturing or distributing any type of weapon in the state without receiving prior authorization by the competent institutions of the state. Subjects whose right to bear arms has been restricted by a judiciary branch of the state are not allowed to possess weapons until said order expires.



SA-PSC § V.5. Possession of explosive material and biological/chemical agents [F]

The mere handling of explosive material, or other biological and/or chemical agents that can greatly affect the well-being of others, is strictly illegal.

 

SA-PSC § V.6. Possession of weaponry [M]

Possession of any weaponry without a weapon license is strictly prohibited. 

A police officer may revoke your weapon license after you have been found committing a crime involving weapons.

 

SA-PSC § V.7. Unlisted objects created for an unlawful purpose

Any object that is not listed in this list whose purpose of creation was to violate the rights or safety of others, such as burglary tools can be put up to trial to the judiciary branch of the state.

 

SA-PSC § V.8. Miscellaneous items [F]
It is strictly prohibited to possess, use, and distribute the items listed below with the exceptions of brass, silver, gold jewelry, and gold bars under the criteria in the list.

  • Highways are not limited by any speed restrictions.

 

Failure to obey the speed limitations is punishable by a fine.

The speed limits in the great state of San Andreas are the sequent:

Any form of promotional or discount offer must comply with the range of prices set for delivery charges under state law. Any form of promotional or discount offer is not permitted to go below the minimum threshold for delivery charges specific under state law.

Failure to obey the prices range shall be punished with a monetary fine no less than $100,000 and no more than $500,000.

- For crates delivery: 

   Minimum $200 per crate;

   Maximum $400 per crate;

- For liquid delivery:

   Minimum $10 per liter;

   Maximum $40 per liter.

Transportation companies operating in the state must adhere to the following price range for delivery charges to their customers. This price range applies to all forms of delivery, including but not limited to crates and liquids.

Violations of these provisions may result in a monetary fine of between $100,000 and $500,000.

SA-PSC § II.12. Failure to pay a fine [M]

The act of failing to pay a fine that has been lawfully forced upon the individual due to a violation of the codes of the state. Fines are to be paid at the City Hall, failure to pay the fines on period of seven(7) days, can be punished by an arrest and impounding of the vehicle for a period of one(1) day, repetitive offenders may receive up to three (3) days vehicle impound.

 

 


ARTICLE VIII. MISCELLANEOUS LAWS

 

 

SA-PSC § VII.9. Restricted Areas

Certain government facilities and buildings are to have restricted access to the public due to the nature of the agency residing in the area and the safety of the public and the employees themselves. As such, the following areas are to be considered of restricted access:

  • Los Santos Police Department including the interior space the yard on the northern side, the garage, and the premises in front of the building on the west side.
  • Las Venturas Police Department including the interior space, the parking on the west side, the garage and the premises on the south side of the building.
  • San Fierro Police Department including the interior space, the parking on the south side, the garage and the premises of the building on each side.
  • Special Weapons and Tactics training facility at north-east Las Venturas including the premises around the exterior fence.
  • Special Weapons and Tactics headquarters at Los Santos, Commerce, including the premises west of garage to the sewer access road and the garage.
  • Federal Bureau of Investigation, Los Santos Headquarters, including the interior space, the garage and the premises of the building on all sides.
  • Federal Bureau of Investigation, Las Venturas Office, including the interior space, the garage and the premises of the building on all sides.
  • Federal Bureau of Investigation, San Fierro Office, including the interior space, the parking space on the west side and the premises of the building on all sides.
  • Area 51 including the premises stretching to the access road on the west side, to the hills on the north and east side and south side.
  • U.S. ARMY National Guard, Easter Basin base, including the interior space, the fenced yard, and the premises of the wharf.
  • U.S. ARMY National Guard, Ocean Docks Base south bounds, including the interior space, the fenced yard, and premises of the area.
  • White House including the premises stretching throughout the whole Verdant Bluffs area.

Do note that the citizens may access the public areas of the aforementioned buildings such as their reception/lobby areas only. However, the access to these areas as well can be restricted in times of need, the employees of the agency in question reserve the right to temporarily restrict additional area related to their building due to security threats or other reasons which require restricted access.

ARTICLE III. 
CRIMES AGAINST THE UNITED STATES OR A STATE

  • SA-PSC § II.3.1. Law Enforcement vehicles
    • San Andreas Police Department and San Andreas Sheriff Department are the only recognized law enforcement agencies on the state level and have jurisdiction in each of the three cities, along with the counties. The SAPD's field staff vehicles are to be colored in combination of black and white colors, and the SAPD Idlewood Precinct's fleet to be colored in a combination of light brown and white colors, while the SASD must use a combination of green and white colors. The supervisory and command staff vehicles are to be colored according to command staff and higher ranks preference with the permission of Secretary of Law Enforcement (Unless the position is VACANT, in which case, the permission will come directly from the Governor), with the exception of unmarked vehicles, but inclusive of high speed pursuit vehicles and divisional vehicles. The vehicles used by SAPD's Academy Division are to be colored fully white for training purposes. The writings of the markings on these vehicles is to be white, blue or yellow. The primary color of emergency lights used by both departments is to be blue and red. These vehicles may make use of emergency audible sirens.
       
    • The Federal Bureau of Investigation is the only recognized federal law enforcement agency and has jurisdiction throughout the United States of America. The FBI's vehicles are mostly unmarked and colored in variety of colors. Generally, the primary colors are black and dark-green depending on the division. The writings of the markings on these vehicles is to be yellow or white. The primary color of emergency lights is to be blue and red. These vehicles may make use of emergency audible sirens.

The SAFD's official vehicles are to be colored in combination of red and white colors, red for supervisory & command staff of Fire Department's Fire Suppression & Rescue(FD) while white and light blue combination are reserved for supervisory & command staff vehicles of the Fire Department's Emergency Medical Services(EMS). The primary color of emergency lights is to be red, whilst combinations may include white or yellow as secondary. These vehicles may make use of emergency audible sirens.

ARTICLE VII. TRAFFIC LAW

 

 

Added;
SA-PSC § VII.22. Unsafe Turning [IF]

It is prohibited to make an unsafe turning(illegal u-turn) in a manner that endangers other drivers or pedestrians, or that violates traffic signs. This includes making a turn where there is a solid yellow line in the center of the road indicating no passing or making a U-turn at an intersection or other location where a U-turn is specifically prohibited by traffic signs. Violations of this law is punishable by a fine.

 


ARTICLE IX. BUSINESS REGULATIONS

 

Added;

SA-PSC § IX.7. State-Mandated Fuel Prices for Gas Stations.

All gas stations operating within the state of San Andreas are required to adhere to the following price ranges for fuel. Violations of these provisions may result in a monetary fine of between $50,000 and $250,000.
 

At region of Los Santos & Red County & Flint County;
Minimum; 30$ per liter.
Maximum; 50$ per liter.


At the rest of San Andreas region(San Fierro, Las Venturas, Bone County, Tierra Robada, Whestone);
Minimum; 15$ per liter.
Maximum; 30$ per liter.

Gas stations are prohibited from charging customers any price for fuel that falls outside of the minimum and maximum thresholds set by state law. Any violation of these provisions may result in legal action being taken against the gas station in question.
 


ARTICLE VIII. MISCELLANEOUS LAWS

SA-PSC § VIII.10. San Andreas Impound & Towing (SAIT)
The San Andreas Impound & Towing (SAIT) is a government agency established to enforce traffic laws in the great state of San Andreas. SAIT is responsible for the impoundment of vehicles that violate traffic laws, either by law enforcement order or by the agency's operators. SAIT's main duty; to impound vehicles violating SA-PSC § VII.8. Illegal Parking from Article VII, Traffic Laws section.

  • SA-PSC § VIII.10.1. Authority of San Andreas Impound & Towing.
    SAIT has the authority to impound a vehicle for the following violations:
    - Parking in a no-parking zone
    - Blocking a fire lane or emergency exit
    - Parking in a handicap parking spot without a proper permit
    Generally, SAIT enforces "SA-PSC § VII.8. Illegal Parking", or enforces the entire traffic law section under the orders of the Law Enforcement Agency. Individuals who violates these laws will have their vehicle impounded for a period determined by SAIT.
  • SA-PSC § VIII.10.2. Appeals Process.
    Individuals who have their vehicle impounded by SAIT have the right to appeal the decision. The appeal process can be initiated by submitting a request to the agency within 7 days of receiving the impoundment here.
  • SA-PSC § VIII.10.3. Other Provisions.
    - SAIT works under certain policies established within the agency and with the approval of the government, SAIT may establish additional policies and procedures as necessary to carry out its mission. Any changes to policies and procedures must be approved by the appropriate government officials.
    - SAIT vehicles identified with the sign "SAIT" on the vehicle's body. SAIT stands for San Andreas Impound & Towing.
  • SA-PSC § VIII.10.4. Severability.
    If any provision of this law is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

SA-PSC § II.25. Illegal street racing [M]

A person who, without having a proper license/authority to host a street racing activity, or participates in said activity is submitted to an arrest and vehicle impounded. All events that take place on public grounds must be registered through law enforcement and all such permits can be granted by a SAPD command member+ or a SASD command member+ depending on which department has the jurisdiction the event will take place at after presenting certain documents including a safety plan.

SA-PSC § VIII.11. Fleet Services Division (FSD)
The Fleet Services Division in short term F.S.D, is a state government agency that's specialized in maintaining and repairing official government agency's vehicles including, San Andreas Police Department, San Andreas Fire Department, Federal Bureau of Investigation, San Andreas Government and US Army National Guard.

  • SA-PSC § VIII.11.1. Authority of FSD
    To hold right of passage on the road when responding to an emergency.
    To be able to violate the speed limits and traffic orientation if needed to perform their duties.
    - To make use of red, blue, yellow light sirens, and audible sirens.
    - To establish roadblocks for emergency operation/service for temporary period all over the state.

    - To supply identity cards to the respective agencies to access their gates.
  • SA-PSC § VIII.11.2. Duty and Obligations
    FSD's main priority is improving, repairing, assisting in towing respective agencies vehicles that are mentioned in SA-PSC § VIII.11. as well as responding to emergency accidents that involve the said vehicles or its maintenance.
  • SA-PSC § VIII.11.3. Provisions and function
    - FSD works under certain policies established within the agency and with the approval of command of the agency, the government in certain cases, FSD may establish additional policies and procedures as necessary to carry out its mission. Any changes to policies and procedures must be approved by the appropriate government officials.
    - FSD vehicles identified with the sign "Fleet Services Division" or "FSD" on the vehicle's body, plated SA #### FSD. FSD stands for Fleet Services Division.

The Commissioner of the San Andreas Highway Patrol is granted the power to:

  • Assume any able-bodied and of sound mind individual to assist in the enforcement of the state law, as well judiciary orders of the court;
  • Ensure the Highway Patrol has sufficient manpower to combat crime;
  • Ensure the Highway Patrol has equipment and weapons necessary to overpower criminal forces;
  • Take necessary actions to ensure law and order in the State;

SA-PSC § II.3.5 San Andreas Highway Patrol (SAHP) Vehicles
◦ The San Andreas Highway Patrol (SAHP) fleet shall be colored black and white for all divisions, except for unmarked units. All departmental fleet vehicles may use emergency audible sirens and lights with red, blue, and amber colors. Unmarked unit vehicles are those without any markings that may identify them as law enforcement vehicles, such as wordings and plate numbers (e.g., SA #### HP).

ARTICLE II. CRIMES AGAINST A PERSON

SA-PSC § I.19. Prohibition of Discriminatory Acts [M]
It shall be unlawful for any person, organization, or entity to engage in any act of discrimination based on race, ethnicity, color, nationality, religion, gender, sexual orientation, disability, or any other protected characteristic. Discrimination includes but is not limited to verbal, written, or online harassment, hate speech, unequal treatment, segregation, and exclusion based on protected characteristics.
The punishment for offenders found guilty of engaging in discriminatory acts shall be fined with $10.000 or imprisonment for 15 months, depending on the severity of the offense.

ARTICLE X. STATE LICENSED SECURITY COMPANIES


SA-PSC § X.1. Security Companies
A security company must be licensed to operate by the state in order for their activities to be considered legal. The license is obtainable from the Department of Licensing.

 

SA-PSC § X.2. Use of force
A licensed security company may use force that is proportionate to the threat, only when actively protecting property or individuals who have employed the licensed security company for such a task. When faced with a non-lethal force, such as an attack by use of melee weapons or fists, the proportionate response would be returning with a melee weapon or fists.

 

Once force has been used against an individual, a law enforcement agency must be called on scene to investigate further. Should it be determined that a security official used disproportionate amount of force, the security official must be terminated from the security company, in addition to other lawful proceedings law enforcement agencies may execute.

 

SA-PSC § X.3. Lethal and non lethal weapons

Non lethal weapons are, but not limited to: a baseball bat, a cane, a nightstick, brass knuckles, pepper spray and others that do not shoot projectiles.

Lethal weapons are, but not limited to: knife, colt45, desert eagle, UZI and others that shoot projectiles.

 

SA-PSC § X.4. Concealment of identity

Licensed security companies, when actively protecting property or individuals who have employed the licensed security company for such a task, may not conceal their identity by use of mask or other items. They must be easily identifiable and must present ID when requested by law enforcement.

 

SA-PSC § X.5. Vehicles

Licensed security companies may not utilize any emergency lights or sirens. They may not violate traffic laws nor prohibit passage to vehicles. In case they are hired to provide security to an individual who has to be escorted in a convoy, they must request a San Andreas Highway Patrol unit, or a San Andreas Police Department unit to provide escort to such a convoy, where blockage of passage to other vehicles and priority are required.

 

SA-PSC § X.6. Use of restricted items

A licensed security company may utilize M4 assault rifle and a sniper rifle and is exempt from the prohibition of said weapons only when actively protecting properties or individuals. Other restrictions, on weapons or items that are not specially exempt here, still apply.

With the recent departure of the Federal Bureau of Investigation (FBI) from San Andreas, the United States Government in conjunction with San Andreas Government hereby alters the jurisdiction of San Andreas Police Department in the following way:

 

*** AMENDMENT 1 —

The San Andreas Police Department, as the state-wide law enforcement agency, is responsible for law enforcement throughout San Andreas, within all its cities and counties.

 

*** AMEDNMENT 2 —

The San Andreas Police Department's Detective Bureau will assume the FBI's jurisdiction in the following matters:

  • Terrorism and counterterrorism;
  • Intelligence gathering and counterintelligence;
  • Cyber crime;
  • Civil rights;
  • Organized crime;
  • White-Collar crime;
  • Violent crime;
  • Weapons of mass destruction;
  • Illegal immigration and human trafficking;
  • Production and distribution of narcotics and weapons;
  • Protection government officials;

*** AMEDNMENT 3 —

With consideration of Amendment 2, the San Andreas Police Department's Detective Bureau, its proceedings and investigations precede that of any other department or agency. They are permitted to investigate and conduct proceedings on government officials, other law enforcement officials and any other public service employees.

In addition to the aforementioned, a reminder to all that despite FBI's departure from San Andreas State, it is still prohibited by law to impersonate a law enforcement officer of any agency, including "FBI".
