Gun Control Act 2022

 San Andreas Government

Ratified by Tyche Blackfyre on the 10th of February 2022 and enters into force on the 17th of February 2022.

 

Due to the increased rate of homicide, the State Government decided to create the "Gun Control Act" as a method to guarantee the safety of the citizens of the state. The Gun Control Act is to be used by the San Andreas Police Department as a legal ground.

Clarifications:
Loaded ammunition/vehicle storage - That's the ammunition amount a person is allowed to hold or to store in his personal vehicle.

Property storage - That's the total ammunition amount a person is allowed to store in all his properties.

Legal status - There are four types of legal statuses - "legally allowed" ; "limited to specific amount" ; "temporarily prohibited" and "prohibited".

GCA §1. Definitions.

(1) The term "person" and the term "whoever" include any individual, corporation, company, association, firm, partnership, society, or joint stock company.

(2) The term "firearm" means (A) any weapon which will or is designed to or may readily be converted to expel a projectile by the action of an explosive; (B) the frame or receiver of any such weapon; (C) any firearm muffler or firearm silencer; or (D) any destructive device. Such term does not include an antique firearm.

(3) The term "ammunition" means ammunition or cartridge cases, primers, bullets, or propellent powder designed for use in any firearm.

(4) The term "property storage" means the property where the gun ammunition is stored.

 

GCA §2. Categorization

(1) Pistols - Colt 45, Colt 45 with suppressor (silenced pistol), desert eagle

(2) Shotguns - Sawnoff Shotgun, Pump Shotgun, Spaz 12 (combat shotgun)

(3) Submachine guns - Tec9, Uzi, MP5

(4) Assault weapons - AK-47, M4

(5) Sniper rifles - Country rifle, Sniper rifle

(6) Heavy weapons - Flamethrower, Minigun, Rocket Launcher, Heat-Seeking Rocket Launcher

(7) Explosive weapons - As described in SA-PSC § V.5

 

GCA §3. Unlawful acts.

(a) It shall be unlawful -

(1) for any person - 

(A)except for SAPD personnel, including Volunteer Troopers, off-duty officers and volunteers are to be treated as regular citizens.

 

To possess and store more ammunition than:

20 cartridges of Desert Eagle / 100 stored cartridges of Desert Eagle in their properties;

20 cartridges of Shotgun / 100 stored cartridges of Shotgun in their properties;

20 cartridges of Rifle / 100 stored cartridges of Rifle in their properties;

0 cartridges of MP5, TEC9, UZI, AK-47, M4, Combat shotgun

0 ammunition of Flamethrower, Rocket Launcher, Heat-seeking rocket launcher, Minigun

GCA §4. Penalty

(1) The possession of any quantity of ammunition higher than the limits mentioned in GCA §3  is to be treated as a misdemeanor. 

(1.1)Except for weapons in category "Assault weapons", "Heavy weapons", "Explosive weapons" and weapons "Spaz 12" and "Sniper rifle". They are to be treated as it follows in the state law for:

SA-PSC § V.2. Possession of an assault weapon or a sniper rifle [FELONY]

SA-PSC § V.5. Possession of explosive material and biological/chemical agents [FELONY]

 
(2) If a person is proven guilty by any law enforcement organization of possessing any quantity above the aforementioned limits, the penalty is as follows:
minimum a citation of $4,500 on first offense;

minimum $9,000 and weapon license revoking on second offense;

detention, $9,000 and weapon license revoking on third offense.
