ARTICLE IX. STATE BUSINESS REGULATIONS


SA-PSC § IX.1. State businesses

Any business that has been officially accepted to the State Business Support Fund by the State Government is hereby considered to follow the State Business Regulations and considered as a State business. State business must fill the need of demand for their services, activity requirements and must be an established group (/group). The State reserves the right to conduct investigations and audit the State businesses at any time. Failure to abide by the State Business Regulations will result in immediate dismissal from the program and/or monetary consequences or a jail sentence.

SA-PSC § IX.2. Taxation & Accounting
All State businesses are obligated to keep track of their income and outcome and forward the Department of Treasury a monthly report. All State businesses are obligated to pay 10% income tax to the Government starting from 1,000,000$ income that the business generates on the previous month. Failure to provide monthly accounting statistics will result in removal from the program and already given funds for the month to be retrieved.

SA-PSC § IX.3. Falsifying records [F]
Any attempt to forge documents or falsify accounting documents is classed as a felony charge.

SA-PSC § IX.4. Official State prices for vehicles
State dealership businesses must follow the list below when purchasing or selling a standard condition or class vehicle. The dealership is required to purchase vehicles from any citizen at all times and refund them the money they receive from selling the vehicle to the State's dealership (NPC).

(( Clarifications: Players are still allowed to make deals with each other. State owned dealerships are used like you would use the old dealership function. If you wish to sell your vehicle for the dealership price, the State owned dealership MUST accept the vehicle and sell it back to the dealership for you and transfer you the money - price can be negotiated with in the range of 10,000$. Please note that you will only get the dealership price for the vehicle, if you have modifications or you have it in a upgraded version that will NOT be reimbursed back to you. State run dealerships can be negotiated with if you wish to sell a high-end, unique or modified vehicle - but they are NOT required to make the deal if the price does not fit them and you do not come to a deal. ))

SA-PSC § IX.5. Official State pricelist for furniture & construction companies
Furniture & Construction companies must follow the appointed pricelist found below when offering their services to clients. Price may vary by the amount of furnishing objects used and the cost of the purchased furnishing objects: 0-10 objects ($5,000), 11-20 objects ($10,000), 21-30 objects ($15,000), 31+ objects ($20,000). Each furniture & construction company may add their own price for drawing up sketches/blueprints for the client and ask additional fees for various of services if the client requests so.

SA-PSC § IX.6. Official State pricelist for logistical companies
Transportation companies may offer to deliver crates and gas to their customers ranging from 200$ to 400$ per crate and 10$ to 40$ per liter of fuel. Price could vary based on the location of the business.

SA-PSC § IX.7. Usage of State Business Support Funds
Funds can be used for employee paychecks, purchasing tools to promote company services and tools required to provide services.

Added - Article II. 09/OCT/2020

SA-PSC § II.22. Blocking public access roads/paths [M]

Any public access road or a pedestrian path must be kept clear for citizens to move freely. Obstructing any public access road or a pedestrian path by adding furniture is considered to be a misdemeanor act. The owner of the said property is responsible and will face a written notice, after two days of said written notice and if the owner has not still removed the obstacle, the owner will be given a citation (maximum penalty of 25,000$) by the State Government. Failure to pay said citation to the Department of Treasury within a period of another two days and/or has failed to remove the obstruction from the road/path will result in an arrest and the blockage on the road/path to be cleared by the State.

SA-PSC § II.23. Illegal gambling [M]
A person who, without having a proper license/authority to host gambling activities inside a casino, participates in a gambling activity outside of an official casino is submitted to an arrest.

SA-PSC § IX.8. Gambling license [F]
In order to operate as a casino and hold gambling related activities/games the owner/lessee of the said business must have obtained a gambling license from the Department of Licensing. The State Government holds the right to make random check-ups to confirm the validity of the dealers and if the business has a valid gambling license. Please note that all dealers must be verified by the casino owner/lessee and listed as official dealers of said enterprise in the state database or on their own website.

It is up to the owner/lessee of the casino to make sure that the establishment is not being used by third parties. The owner of the casino and/or the lessee of the casino can face a monetary fine up to 500,000$ per violation of the SA-PSC § IX.8. Gambling license.

SA-PSC § II.24. Electoral bribery 

A person cannot ask for, receive or obtain, or give or confer, any property or benefit with the intention of influencing the vote of a person at a state election. If a person is found guilty of this offence, a court may impose a penalty of monetary fine or imprisonment.

    The manufacture of any drug, also known as narcotics or controlled substances, is strictly prohibited unless you are properly licensed by state and federal authorities. Drug manufacturing occurs whenever a person participates in any part of the process involved in creating an illegal drug. Manufacturing activities can include mixing together chemicals in preparation for creating Heroin, “cooking” or producing methamphetamine, as well as growing marijuana plants. Even offering to assist in the drug manufacturing process is enough to qualify as drug manufacturing. Drug manufacturing requires that the defendant had knowing possession of a drug, or the chemicals necessary to manufacture a drug and that he or she had an intent to manufacture. Manufacturing is a felony classification.

Attempted murder, also referred to as attempted homicide, is the incomplete or unsuccessful act of unlawfully killing someone. Attempted murder, unlike the criminal act of murder, does not result in the death of another person. The offender shall serve a prison sentence no lower than 3 years and no longer than 8 years.

    Anyone who commits an assault on another person with a deadly weapon or instrument will be punished by imprisonment in state prison for up to three years. Assault with a deadly weapon occurs when you assault another person with a deadly weapon or using force that is likely to produce a great bodily injury. A deadly weapon is an item that can inflict mortal or great bodily harm.


SA-PSC § I.17. Manslaughter

Manslaughter is the illegal killing of a person by someone who did not intend to kill them. A person commits the offense if he recklessly causes the death of an individual. The offender shall serve a prison sentence no lower than 2 years and no longer than 5 years.

  • SA-PSC § I.17.1 Vehicular Manslaughter
    When a driver of a motor vehicle acts in a negligent or even "grossly negligent" manner, but with no "malice" or intent to harm, and the result of said action is the death of another person. The offender shall serve a prison sentence no lower than 1 year and no longer than 3 years.

It is strictly forbidden in the great nation of San Andreas, the acts of introducing, manufacturing, possessing or distributing dangerous drugs like heroin, meth, weed or cocaine. If elements are located alongside with the unlawful substance, and they are used to produce these substances, they are to be seized with the drugs. If found calcium, sodium and acetone or lithium, toluene and acetone are together without drugs then also it has to be seized for some security reasons. Same applies to weed seeds.

 

TL;DR.

 

Citizens are now able to possess a maximum of 0g Weed, 0g Heroin, 0g Meth.

Citizens were able to hold a maximum of two (2) joints/syringes.

Citizens are now able to possess a maximum of (0) joints/syringes.

SA-PSC § V.1. has been amended as of 11th of November 2021 to the following form:

 

SA-PSC § V.1. Possession of an illegal substance [M]/[F]

It is prohibited in the State of San Andreas to be in possession or to distribute or to manufacture the following narcotisc:

  • Weed if in amount higher than 350 grams or a joint if more than 1;
  • Heroin or heroin syringe;
  • Meth;
  • Cocaine;

 

  • SA-PSC § V.1.1. Property Search
    If the subject of a search is found to be in possession of narcotics in amount 350 grams above the limit specified in SA-PSC § V.1., a warrant request may be sent to the persons of authority to approve warrants, against the subject's properties, which are then to be searched and seized of eventual illegal items that are found.
  • SA-PSC § V.1.2. Property Seize 
    If upon execution of a search warrant, a property is found to be used for the production of weed (there is weed being grown in the property), the property may be seized for a period of 7 days to conduct further investigation into the owner of the property and the use of the produced substance.

SA-PSC § V.1. has been amended as of 19th of January 2022 to the following form:

 

SA-PSC § V.1. Possession of an illegal substance [M]/[F]

It is strictly forbidden in the great state of San Andreas, the acts of introducing, manufacturing, possessing or distributing harmful drugs like heroin or cocaine or meth, with the exception of weed which may be legally possessed by an individual for up to a limit of 750 grams. If ingredients are found alongside with the illegal substance, and they are used to produce these substances, they are to be seized with the drugs. The exception to prohibited possessions also include the sole possession of upto two joints.

 

  • SA-PSC § V.1.1. Property Search
    If the subject of a search is found to be in possession of more than 250 grams of heroin/meth or 750 grams of weed a warrant request may be sent to the persons of authority to approve warrants, against the subject's properties, which are then to be searched and seized of eventual illegal items that are found. 
  • SA-PSC § V.1.2. Property Seize 
    If upon execution of a search warrant, a property is found to be used for the storage of illegal substances (such as Weed, Meth, Heroin or Cocaine) in quantities more than the possession limit, i.e., more than 250 grams for heroin/meth or more than 750 grams for weed, the property may be seized for a period of 7 days to conduct further investigation into the owner of the property and the use of the produced substance.
  • SA-PSC § V.1.3. Manufacturing of an illegal substance
    The manufacture of weed is here by declared legal if produced in a controlled property (Weed/Garden Houses). The quantity produced should be less than or equal to the possession limit i.e., 750 grams. If a group or an individual is found manufacturing/producing weed in any quantity outside controlled properties (such as weed farms) it will be considered as a felony and be treated as such. 
    Note: This does not apply to other illegal substances such as Heroin, Cocaine & Meth, they are and will be illegal if found while manufacturing or in possession.

SA-PSC § II.23. Illegal gambling [M]

A person who initiates and/or participates in a gambling-type activity outside of an official casino is submitted to an arrest.

SA-PSC § IX.8. Gambling license [F]
In order to operate as a casino and hold gambling related activities/games the owner/lessee of the said business must have obtained a gambling license from the Department of Licensing. The State Government holds the right to make random check-ups to confirm the validity of the dealers and if the business has a valid gambling license. Please note that all dealers must be verified by the casino owner/lessee and listed as official dealers of said enterprise in the state database or on their own website.

It is up to the owner/lessee of the casino to make sure that the establishment is not being used by third parties. The owner of the casino and/or the lessee of the casino can face a monetary fine up to 500,000$ per violation of the SA-PSC § IX.8. Gambling license.

SA-PSC § II.23. Illegal gambling [M]

Commercial gambling means gambling where the owner, operator, or host of a gambling event receives something of value from the game or charges a fee to the players participating. Whoever conducts, finances, manages, supervises, directs, or owns all or part of an illegal gambling business shall be fined under this title or imprisoned not for more than 6 months, or both.
Gambling inside a casino without an active gambling license is considered illegal gambling. The term “gambling” includes but is not limited to bookmaking, maintaining slot machines, roulette wheels or dice tables, and conducting lotteries or numbers games, or selling chances therein.

SA-PSC § IX.8. Gambling license [F] 

In order to operate as a casino and hold gambling related activities/games the owner/lessee of the said business must have obtained a gambling license from the Department of Licensing. Note : The State Government provides all casino owners with one week grace period to renew their expired gambling license.

An ALS program was invented by the San Andreas Fire Department, ALS fields are as defined:

ALS stands for Advanced Life Support. A person who provide ALS without certification issued officially by the San Andreas Fire Department, shall be fined with no less and no more than $50,000 on first offence, imprisoned for 1 year on second offence, imprisoned for 5 years on third offence

    The manufacture of any drug, also known as narcotics or controlled substances, is strictly prohibited unless you are properly licensed by state and federal authorities. Drug manufacturing occurs whenever a person participates in any part of the process involved in creating an illegal drug. Manufacturing activities can include mixing together chemicals in preparation for creating Heroin, “cooking” or producing methamphetamine, as well as growing Cannabis Indica/ Sativa. Even offering to assist in the drug manufacturing process is enough to qualify as drug manufacturing. Drug manufacturing requires that the defendant had knowing possession of a drug, or the chemicals necessary to manufacture a drug and that he or she had an intent to manufacture. Manufacturing is a felony classification. If a group or an individual is found manufacturing/producing drugs in any quantity whether in property or in farms, the group or an individual was found producing or participating in producing the drugs is punished with a jail sentence (along with the seizure of the pot if found being used to grow the cannabis).

AMENDMENT
ARTICLE IX. STATE BUSINESS REGULATIONS


SA-PSC § IX.1. State businesses

Any business that has been officially accepted to the State Business Support Fund by the State Government is hereby considered to follow the State Business Regulations and considered as a State business. State business must fill the need of demand for their services, activity requirements and must be an established group (/group). The State reserves the right to conduct investigations and audit the State businesses at any time. Failure to abide by the State Business Regulations will result in immediate dismissal from the program and/or monetary consequences or a jail sentence.

SA-PSC § IX.2. Taxation & Accounting
All State businesses are obligated to keep track of their income and outcome and forward the Department of Treasury a monthly report. All State businesses are obligated to pay 10% income tax to the Government starting from 1,000,000$ income that the business generates on the previous month. Failure to provide monthly accounting statistics will result in removal from the program and already given funds for the month to be retrieved.

SA-PSC § IX.3. Falsifying records [F]
Any attempt to forge documents or falsify accounting documents is classed as a felony charge.

SA-PSC § IX.4. Official State prices for vehicles
State dealership businesses must follow the list below when purchasing or selling a standard condition or class vehicle. The dealership is required to purchase vehicles from any citizen at all times and refund them the money they receive from selling the vehicle to the State's dealership (NPC). 


Dealerships do not need to follow the pricelist when it comes to exchanging heavily modified, unique and high-end vehicles which are the following:


Any vehicle that has the following modification is excluded from the state assigned dealership price:


(( Clarifications: Players are still allowed to make deals with each other. State owned dealerships are used like you would use the old dealership function. If you wish to sell your vehicle for the dealership price, the State owned dealership MUST accept the vehicle and sell it back to the dealership for you and transfer you the money - price can be negotiated with in the range of 10,000$. Please note that you will only get the dealership price for the vehicle, if you have modifications or you have it in a upgraded version that will NOT be reimbursed back to you. State run dealerships can be negotiated with if you wish to sell a high-end, unique or modified vehicle - but they are NOT required to make the deal if the price does not fit them and you do not come to a deal. ))

SA-PSC § IX.5. Official State pricelist for furniture & construction companies
Furniture & Construction companies must follow the appointed pricelist found below when offering their services to clients. Price may vary by the amount of furnishing objects used and the cost of the purchased furnishing objects: 0-50 objects (+/- $500,000), 51-100 objects (+/- $1,000,000), 101-150 objects (+/- $1,500,000), 151+ objects (+/- $2,000,000). Each furniture & construction company may add their own price for drawing up sketches/blueprints for the client and ask additional fees for various of services if the client requests so.

SA-PSC § IX.6. Official State pricelist for logistical companies
Transportation companies may offer to deliver crates and gas to their customers ranging from 300$ to 500$ per crate and 25$ to 40$ per liter of fuel. Price could vary based on the location of the business.

  • SA-PSC § IX.6.1 Fuel Charges for Gas Stations
    Gas Stations owners are obligated to sell fuel from $25 to 40$ in rural areas (Countryside) and 30$ to 50$ in urban areas (Los Santos, San Fierro and Las Venturas) respectively. Failure to abide by state price list is punishable by 13,000$ for a person, and 130,000$ for a listed corporation. Repetitive offenders may receive a jail sentence which can be determined by the court.


SA-PSC § IX.7. Usage of State Business Support Funds
Funds can be used for employee paychecks, purchasing tools to promote company services and tools required to provide services.
